These Terms of Service ("Terms") govern your use of makemesnore.com and your purchase of any product from us ("Make Me Snore", "we", "us"). By using the site or placing an order you agree to these Terms. If you do not agree, please do not use the site.
1. Who can order
You must be at least 18 years old and able to form a binding contract. Our products are not for use by anyone under 18. By ordering you confirm that the information you give us is accurate and that you are authorised to use the payment method you provide.
2. Products, pricing and availability
We try to describe our products accurately, but we do not warrant that descriptions, images, pricing or other content are error free. Colours and packaging may differ slightly from photographs.
Prices are in US dollars and may change without notice. We reserve the right to correct pricing or description errors, and to cancel or refuse any order, including after an order confirmation has been sent, where an obvious error has occurred or where we suspect fraud. If we cancel an order you have already paid for, we refund it in full.
All orders are subject to acceptance and availability.
3. Subscriptions
The Sleep Club is a recurring subscription that renews automatically until cancelled. By joining you authorise us to charge your payment method on the stated cycle. Full terms, including how to cancel, are in our Subscription Terms, which form part of these Terms.
4. Payment
Payment is taken at checkout, and for subscriptions on each renewal. You authorise us and our payment processors to charge the payment method you provide for the total amount of your order, including tax and shipping.
5. Shipping, title and risk
Shipping terms are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you when the carrier takes possession of the parcel.
6. Returns and refunds
Refunds are governed by our Refund Policy, which forms part of these Terms. In summary: a refund is available on request within 30 days of delivery, limited to one refunded order per customer or household, and any refund after that window is entirely at our discretion.
7. Health disclaimer
Make Me Snore is a dietary supplement. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
Nothing on this site is medical advice, and we are not your healthcare provider. Consult a qualified healthcare professional before use, particularly if you are pregnant, nursing, trying to conceive, taking any medication (including sedatives, blood thinners, blood pressure medication or antidepressants), or have a medical condition. Do not drive or operate machinery after taking. Keep out of reach of children.
Individual results vary. Customer reviews and testimonials describe individual experience and are not a guarantee that you will experience the same.
8. Your account
If you create an account you are responsible for keeping your credentials secure and for activity that happens under your account. Tell us promptly at hello@makemesnore.com if you think it has been compromised.
9. Acceptable use
You agree not to use the site to break the law, infringe anyone's rights, interfere with the site's operation or security, scrape or harvest data, resell our products without our written permission, or submit false or misleading information.
10. Intellectual property
The Make Me Snore name, logo, packaging, copy, photography and site design are our property or licensed to us, and are protected by intellectual property law. You may not copy or use them without our written permission.
11. Content you submit
If you send us a review, photo, comment or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our business, including in marketing. You confirm the content is yours to give and is not unlawful.
12. Third-party links and services
The site may link to sites and services we do not control, and our store runs on Shopify. We are not responsible for third-party content, policies or practices.
13. Disclaimer of warranties
To the fullest extent permitted by law, the site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error free.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the site or our products, whether based in contract, tort or any other theory, even if we have been advised of the possibility.
To the fullest extent permitted by law, our total liability arising out of or relating to the site or any product will not exceed the amount you paid us for the order giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
15. Indemnity
You agree to indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the site or our products.
16. Resolving a dispute
If something goes wrong, email hello@makemesnore.com first. Most things are fixed quickly and directly, and we ask that you give us 30 days to resolve a complaint informally before taking further steps.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Wyoming, except that either party may seek injunctive relief in any court of competent jurisdiction.
17. Changes
We may update these Terms from time to time. The version posted on this page at the time you place an order is the version that applies to that order. Continued use of the site after we post changes means you accept them.
18. Severability and entire agreement
If any provision of these Terms is found unenforceable, the rest remains in force. These Terms, together with our Refund Policy, Shipping Policy, Subscription Terms and Privacy Policy, are the entire agreement between you and us about the site and your orders.
